Tina Alai: Domestic prosecution of international crimes — lessons learned from Kenya and the DRC

In this interview, Wayamo International Criminal Lawyer & Project Coordinator, Linda Bore and Tina Alai, Transitional Justice Advisor, UN Commission on Human Rights in South Sudan, discuss the domestic prosecution of international crimes, with a focus on conflict-related sexual violence (CRSV). Tina Alai talks about the Constitutional Petition No. 122 of 2013 filed on behalf of victims of sexual and gender based violence crimes that were committed during the post-election violence in 2008 in Kenya, the Baby Pendo case, and the recent case of 12 police officers charged with crimes against humanity over a crackdown on post-election protests in 2017. She also talks about the Kavumu child rape case (2013-2016) in the Democratic Republic of the Congo.

On transitional justice prospects for Sudan, Tina Alai concludes that a conducive environment is necessary to pursue any form of transitional justice mechanisms. Fighting needs to cease in order for the different parties to come to the table, dialogue and forge a common future together.
